What Lessons Can Be Learned from the Bishop Estate
Case?
January 2001 saw the close of
the long-running dispute between the IRS and the former Bishop Estate trustees,
who agreed to pay the IRS a reported $40,000 each in excess-benefits penalties.
Last fall, the Hawaii attorney general approved a $25 million settlement
– paid by the trustees’ insurance policy (almost half for legal fees, and
the rest to the Estate). Evelyn Brody will discuss the implications of
this case for state and IRS regulation of charities.
