sheltered annuity plans and ineligible deferred compensation plans under Code Section 457, with a particular focus on recent 403(b) regulations and the impact of new Code Section 409A on nonqualified deferred compensation plans.

The Form 990 changed for 2005.
Some of the changes that are seemingly simple, are less simple upon closer examination. This session will focus on areas of Form 990 that are new for 2005; areas that are sometimes problematic for organizations and practitioners; the electronic filing requirements; and potential future changes to the form.

This session will cover hot topics in employment law that affect not-for-profit organizations. It will include discussions of both current legal issues and practical advice and solutions for dealing with those issues.

Planning for Disaster Relief

Recent world events have raised awareness of many issues surrounding the provision of disaster relief by charitable organizations and their donors. The Victims of Terrorism Relief Act of 2001 and IRS Publication No. 3833 set forth the rules applicable to tax-exempt organizations making disaster relief payments. This workshop will focus on specific provisions of interest to corporate foundations and employers who wish to provide assistance to employees that have been victims of a disaster. Understanding the rules in advance can facilitate a quick response in the event of future disasters, whether natural or man made.

Recent governmental and media scrutiny of not-for-profits has furthered widespread discussion of best practices in organizational governance. This session will provide a legal perspective on what constitutes good governance and steps boards can take to protect officers and directors, as well as up-to-date suggestions on risk management and appropriate and available insurance coverage for board members and officers.

IRS Current Developments

In IR-2006-25 the IRS named the 2006 “Dirty Dozen” notorious tax scams and featured schemes designed to exploit exempt organizations. This workshop will focus on enforcement efforts directed at abuses involving supporting organizations, donor-advised funds, and conservation easements. Additionally, it will cover compliance initiatives (hospitals, other) and provide an open forum for participant questions.

Investment Management and UMIFA

This session will discuss the investment and expenditure of charitable funds in light of the current Illinois Uniform Management of Institutional Funds Act, and possible contemplated changes in the model act in light of current investment theory. The panel will also touch on other relevant Illinois statutes affecting investments.

Cancellations and Refunds
Written notification of cancellation is required. A full tuition refund is available if notification is received prior to May 19, 2006; 25% will be charged if notification is received between May 19 and June 2, 2006. No refunds will be granted after June 2, 2006.

CPE Credit
8.0 hours on a “50-minute” credit hour. Chicago-Kent College of Law is a registered public accountant professional education sponsor in Illinois and New York.

MCLE Credit
7.0 hours on a “60-minute” credit hour; 8.0 hours on a “50-minute” credit hour. The actual number of approved hours may vary from state to state.
