September 1, 2009 -- Brown Bag Discussion: CNN v. Cablevision

The first presentation for this semester highlights and introduces Chicago-Kent IP faculty in a discussion of the recent Cablevision DVR remote storage case. Professor Hank Perritt will lead a panel that includes Professors Ron Staudt and Ed Lee.

The U.S. District Court ruled that the process of program storage and transfer to a subscriber from Cablevision's remote-storage DVR system directly infringed the content owners' copyrights. On appeal, the Second Circuit reversed on all three grounds and found no direct infringement. The petition for certiorari to the Supreme Court was denied. In order not to "relitigate" Sony issues, the content owners agreed not to pursue secondary liability charges in return for Cablevision's agreement not to use a fair use defense.

Many issues remain unanswered and many new issues have arisen from the Second Circuit's analysis. Join the IP Program faculty for a spirited discussion. Beverages will be provided.

Leimer, practitioner-in-residence with the IP Program and former vice president and associate general counsel, global intellectual property, at the world headquarters of Kraft Foods, and Richard W. Renner, adjunct professor at Chicago-Kent College of Law teaching Trademarks and Unfair Competition Law and former chief intellectual property counsel for Anheuser-Busch Companies, Inc.

The panel will discuss trademark clearance in Latin America. This presentation will be followed by a demonstration of the newest techniques and solutions from CT Corsearch to address your daily challenges.

April 7, 2010 -- IP Speaker, Christopher Carani: Déjà vu All Over Again - Richardson v. Stanley Works (Fed. Cir. 2010) and the new "Point of Ornamentality Test"

An Analysis of the Current State of Design Patent Jurisprudence
Christopher V. Carani, Esq., a shareholder at McAndrews, Held & Malloy, Ltd., is nationally recognized expert in the field of design law, which regards the protection and enforcement of product design through the use of copyrights, trade dress and design patents. He has litigated numerous disputes regarding design rights and has served as a consultant and expert witness in design law cases. In addition to design law, he counsels clients in the consumer product industry on a wide range of domestic and international intellectual property issues. Carani’s recent publication, “The New ‘Extra-Ordinary’ Observer Test for Design Patent Infringement – On a Crash Course with the Supreme Court’s Precedent in Gorham v. White,” was selected as one of the 20 best law review articles of 2009 for inclusion in the Thompson Reuters (West) Patent Law Review 2010. The article explores the current state of design patent infringement law. Carani represented the amicus curiae American Intellectual Property Law Association in the landmark design patent case Egyptian Goddess v. Swisa, which reshaped the law on design patents.

No prior knowledge of design patent law is necessary, as the presentation will begin with some background information. Refreshments will be provided.

April 27, 2010 -- IPLS Speaker Panel: Patent Monetization Strategies -- Changes in an Economic Downturn and Future Evolution

The Chicago-Kent Intellectual Property Law Society is hosting a panel discussion on patent monetization in the current economy. The goals of the panel are to explain how patent monetization has changed during the economic downturn, to discuss new forms of patent monetization, and what to expect in the future.

Michael Friedman, Managing Director at Ocean Tomo, will give a brief introduction of patent monetization strategies focusing particularly on how these strategies have changed in light of the enocomy and how they are expected to evolve over time. The remaining members of the panel are Professors Brad Hulbert and David Schwartz. Lunch will be provided.
