August 31, 2010 -- Panel Discussion: Viacom v. YouTube

A federal court ruled that YouTube fell within the DMCA safe harbor and was not responsible for the copyright infringement committed by users of YouTube. Professors Perritt and Staudt will discuss the ruling and its implications with Professor Lee serving as moderator. All students are invited to attend. Pizza will be served.

September 28, 2010 -- IP/IPLS Brown Bag Lunch

In March 2007, the Recording Industry Association of America (RIAA), the trade association representing major record labels, announced a litigation strategy under which it files, or threatens to file civil lawsuits against individual college students it believes are trafficking in unlicensed music. This strategy supplemented a broader strategy in which the RIAA has sued or threatened to sue more than 30,000 individuals for illegal downloading.
The handful of cases that have reached the courthouse have raised a number of interesting issues about the scope of the Fair Use Privilege under 17 U.S.C. § 107, duties of ISPs under the DMCA, abuse of civil subpoenas, and the psychology of compliance with copyright law.
Steve Scovil, a third year law student, is writing his paper for Professor Perritt's Seminar in Entertainment Law this semester in the form of a screenplay which dramatizes some of the human conflicts the RIAA litigation strategy had engendered. Mr. Scovil and Professor Perritt will present aspects of his screenplay as a foundation for discussion of its characters, plot lines, and the underlying legal issues.

Leading members of the Supreme Court bar, intellectual property practice, and academia will discuss the Supreme Court IP cases of this past year and will preview the upcoming IP cases, along with the First Amendment case involving California's restrictions on violence in video games, in the Court's Term this year. A reception will immediately follow the conference. All students and the public are invited to attend. October 15, 2010 -- "The War on Terroir": Geographical Indications of Origin and Trademark Law

Please join the Chicago-Kent Alumni Association for a mini-CLE lecture on the Geographic Origins of Indication as it pertains to artisanal cheese and wine taught by Chicago-Kent Professors Chris Buccafusco and Sarah Harding. The lecture is followed by a wine and cheese tasting, hosted by the Chicago-Kent Intellectual Property Law Society (IPLS), designed to portray the terroir that makes each product unique and meaningful. For example, one portion of the tasting will be focused on Cabernet Sauvignon-based wines from Bordeaux and Napa Valley in order to highlight the impact that location and local wine-making style has on a given varietal.

The Intellectual Property Law Association of Chicago (IPLAC) and Chicago-Kent's Program in Intellectual Property Law will sponsor an informal discussion on IP career development. The program, entitled "Early Career Development for the New IP Lawyer," will feature a panel of Chicago area IP professionals who will provide students with valuable information and recommendations for developing skills and experience needed to set up a successful career in IP Law. The panelists will provide advice and recommendations for students entering the profession and will discuss the importance of participation in organizations such as IPLAC. Goods that appeal to the senses of sight and sound are thought of as being more or less "aesthetic," and they are governed by copyright law. Goods that appeal to the sense of touch are thought of as having more or less "utility," and they are governed by patent law. What are we to make of this distinction? Does it make sense?
