See You in Court, But Which Court? Venue in Title VII Class Actions

Abstract

By
Elizabeth Lawrence

Title VII has special venue rules, giving plaintiffs more choices than typically permitted under the general venue statue. Instead of being forced to bring suit in the defendant's home court, as is common under the general venue provisions, a plaintiff grieving civil rights under Title VII may be able to choose among several judicial districts.

This article discuses venue choices available under Title VII, and in multi-party cases. Transfer of venue, waiver, and pendant venue are also discussed, as is the impact of the Class Action Fairness Act on Title VII venue choices.
