Supreme Court's 2003-04 Term Employment Law Cases: Clarifying Aspects of Anti-Discrimination Law and ERISA

Abstract

In this article, I summarize the outcomes of the 2003 Term Supreme Court decisions in the fields of employment law. Interestingly, all such cases involved either federal antidiscrimination law or ERISA, so the discussion is organized around these two majors of legislation. Within the context of this discussion, the manner of judicial interpretation is explored with key differences among the justices being highlighted. A final section analyses the case outcomes in terms of judicial ideology and employer vs. employee friendly outcomes.
