Targeting Workplace Harassment in Quebec: On Exporting a New Legislative Agenda

Abstract

This article examines the first piece of anti-bullying legislation in North America, recent amendments to the Quebec Labour Standards Act prohibiting the "psychological harassment" of workers. The author contends that the unique socio-legal context of Quebec contributed to the law's development and structure, possibly rendering it less "exportable" to other jurisdictions. She also suggests that law reform initiatives in this area should include consideration of the relationship between status-blind harassment and discriminatory harassment (such as sexual or racial harassment), while taking stock of our efforts to address discriminatory harassment, in order to see both the possibilities and potential pitfalls of a status-blind approach.
