Crafting a Legislative Response to Workplace Bullying

By
David C. Yamada

Abstract

The main purpose of this Article is to put forth and describe the Healthy Workplace Bill, a model statute I drafted as a legislative response to severe workplace bullying and abusive work environments. The Article starts by describing the phenomenon of workplace bullying. It then examines potential existing legal protections for bullied workers and analyzes why they are inadequate. Next, it describes and discusses the major provisions of the Healthy Workplace Bill. Finally, the Article closes with a discussion of legal and legislative responses to workplace bullying in other nations.
