Q: Why do Brandeis and Story interpret the Rules of Decision Act

A:  J. Brandeis interprets the Act to apply the law of the State,
whether the law of the State is declared by its legislature in a statute
or by its highest court in a decision, while J. Story limits the Act to
state laws--positive statutes of the state--and not decisions of courts.
