Q: The Supreme Court remands to the Second Circuit. What must the court
of appeals do on remand? Anything other than entering judgment for the
railroad?

A: The court of appeals must determine what the state law of
Pennsylvania is regarding the duty owed to Tompkins and the railroads
liability, if any.
