Pennsylvania law, it was claimed by the defendant, stated that persons who use
pathways along the railroad right of way are to be deemed trespassers and that
the railroad is not liable for injuries in the absence of willful or wanton
negligence. There is really no conflicting statute except perhaps the absence
of any statute at all, since the plaintiff denied that Pennsylvania did in
fact have such a statute.
