exclusionary rule

It was permissible for the federal courts to develop the exclusionary rule
because of the Fourthe Amendment right to be free from unreasonable search and
seizure.  It is a rule that governs the exlusion of evidence which is a
procedural matter.  Since the protections guaranteed by the Fourth Amendment
are afforded to citizens by way of the courts, and since the matter is
procedural, a federal rule of procedure governing the exclusion of evidence
falls within the federal court's constitutional powers and does not usurp the
substantive criminal law of any state.
