The Court of Appeals never decided the issue of which state law applies, or
what exactly Pennsylvania state law was. Before entering judgment for the
defendant, the Court must determine what Pennsylvania state law says regarding
railroad liability to pedestrians who use their pathways, and then determine
whether Pennsylvania law is correct or whether some other state law should
apply. Only then could the Court make a decision on whether to enter judgment
for the defendant.
