Justice Brandeis says that the Constitution did not grant federal courts 
power to create federal general common law.  The federal courts do not 
have the power to make substantial rules of common law applicable in a 
state regardless of the nature or type of law.  He says that the Swift 
doctrine created an unconstitutional assumption of powers by the federal 
courts.
