The sovereigns that offered conflicting rules were New York and Pennsylvania law. New York had jurisdiction b/c the company is a corporation of the State (as argued by Tompkins). But Erie railroad claimed Pennsylvania law applied, that people who use pathways along the
railroad right of way are to be deemed trespassers, and thus erie is not liable for injuries to undiscovered trespassers resulting from its negligence, unless wanton or wilful.
