Perhaps a matter of practicality?  Parties have usually prepared for trial
well in advance of filing.  If parties had to wait for a ruling on which
jurisdictions disclosure rules would apply before even beginning to work the
process could experience many delays.  It is more likely that the party
would begin the process prior to the ruling and end up unequally matched at
trial.  Since disclosure is a procedural matter and In order for the  trial
to proceed fairly to both parties it is better that they have identical
disclosure rules.
