It isn't clear in the case but Erie asserts that the application of PN rule was required by Sec 34 of the Fed Judiciary Act requiring the US court to look to "laws of the state". The law of the state where the injury occurred as well as the law where the injured party was domiciled was PN. Since the case is brought in 1938 -- perhaps the rule was lex loci delicti.
