Note on Intent Element of Assault

Ms Sullivan was right and I was wrong.

Section 32 of the Restatement (Second) of Torts says:

"(1) To make the actor liable for an assault, the actor must have intended to inflict a harmful or offensive contact upon the toher or to have put the other in apprehension of such contact."
