The parties agree that any dispute arising out of or related
to this contractual relationship shall be resolved in the following manner, and
the parties consent to and waive objections to this procedure and jurisdiction
in any other forum:
- The dispute process may be commenced by either party
filing a one-page statement of the dispute with the Clerk of the United
States District Court for the District of Montana.
- Upon the filing of a statement of dispute, the clerk shall
assign the case to a district judge.
- The judge shall promptly schedule a “trial by combat,” and
personally supervise such trial.
- At such trial each party shall be represented by a current
officer or employee of its choosing each of whom shall proceed to confront
each other in a “no holds barred” physical contest until one of them is
unconscious or dead. The party sponsoring the other combatant shall
prevail on the merits and the judge shall enter a civil judgment to that
effect.
