Objectives

  1. Make sure YTAMF has a copyright interest in the scenes
  2. Makes sure (under first, joint-copyright option), that the photos qualify as joint works
  3. Make sure YTAMF can do whatever it wants with photos, including commercial exploitation or promotional use for other projects
  4. Make sure Director can do whatever he wants with photos, as long as he associates them with YTAMF
  5. Allow photographer enough elbow-room so he will agree in exchange for a relatively small fee

Draft language

All photographs of YTAMF scenes made by Photographer were authorized and made under the general direction of the Company and the Producer

The photographs contain copyrightable elements of the YTAMF script and music any of the Photographer's creative choices in taking the photographs. The parties indend that these elements be merged into a joint work.

Any photographs of YTAMF scenes made by Photographer are works made for hire.

Photographer, Director, Company, and Producer shall have a joint copyright in the photographs for so long as Photographer and Director describe photographs as comprising scenes from YTAMF and identify the Company and Producer in any materials containing or linking to such photographs.

OR

The Company and Producer own the copyrights in the photograps according to any agreements between them. Photographer and Director each has a non-exclusive license to use the photographs for any purpose so long as they describe photographs as comprising scenes from YTAMF and identify the Company and Producer in any materials containing or linking to such photographs.
